Terms & Conditions

Last updated: 4 September 2026

1. About Us and These Terms

These terms and conditions govern the sale of products through www.ersshop.ie. Please read them before placing an order. By placing an order, you agree to be bound by them.

ERS Shop is the trading name of Electrical Rewind Service (Limerick) Limited, a company registered in Ireland under company number 196398, with its registered office at Unit B1 Corcanree Business Park, Dock Road, Limerick, Ireland, V94 H5W4.

VAT registration number: IE6596398O

Email: info@ersshop.ie    Telephone: (061) 500 600

References to "we", "us" and "our" are to ERS Shop. References to "you" are to the person placing the order.

2. Consumers and Business Customers

Some rights in these terms apply only to consumers, while other provisions apply to business customers.

Consumer. You are a consumer if you are an individual buying products wholly or mainly for purposes outside your trade, business, craft or profession.

Business customer. You are a business customer if you buy products wholly or mainly for use in connection with your trade, business, craft or profession. This includes companies, sole traders, partnerships and other organisations.

If you tell us that you are buying as a business, provide a VAT number or request a trade invoice, we will treat you as a business customer.

Nothing in these terms affects consumers' statutory rights under the Consumer Rights Act 2022 or other applicable Irish consumer law. Where these terms conflict with a mandatory consumer right, that right prevails.

3. Products

We take care to describe and illustrate products accurately. Images are illustrative, and packaging, finish and minor details may vary where this does not materially change the product.

Product specifications, technical data and other manufacturer information are reproduced in good faith. Manufacturers may change specifications without notice. Any substitute or change we supply will still conform to the contract and applicable consumer law.

Please make sure a product is suitable for your intended use before ordering. If you are unsure, contact us before ordering. Any general advice we provide does not replace a site-specific or professional safety assessment.

All products are subject to availability. If a product becomes unavailable after you order, we will contact you and you may choose to wait, accept a suitable alternative or receive a full refund.

4. Safety Equipment and Personal Protective Equipment

Where you purchase personal protective equipment or another safety-related product, you are responsible for selecting equipment appropriate to the hazards involved and for ensuring it is correctly fitted, used, inspected, maintained and replaced in accordance with the manufacturer's instructions and applicable health and safety obligations.

Any protection rating, standard or classification we quote is the manufacturer's stated rating for that product. Read and retain the manufacturer's instructions and declaration of conformity where supplied. Nothing in this section limits liability or statutory rights that cannot lawfully be excluded.

5. WEEE and Battery Take-Back

Electrical and electronic equipment should not be disposed of with general household waste. Where the Irish WEEE rules apply, ERS Shop provides free take-back of household waste electrical and electronic equipment on a one-for-one, like-for-like basis when you buy a new product of a similar type or performing the same function.

  • For Click & Collect purchases, you may return the equivalent old item to our Limerick premises free of charge. Keep your purchase receipt if returning it later.
  • For delivered or online purchases, contact info@ersshop.ie before delivery or return so we can arrange an appropriate free take-back option.
  • Waste portable batteries of a type we sell may be returned free of charge without a new purchase. Contact us before bringing in leaking or damaged batteries so they can be handled safely.

The old electrical item does not need to be the same brand or to have been purchased from ERS Shop, but it must be of a similar type or have performed the same function as the new item.

6. Prices, Promotions and Discount Codes

Prices are shown in euro and include Irish VAT at the applicable rate unless stated otherwise. Delivery charges are shown separately and added at checkout before you confirm your order.

We take care to price products correctly, but errors can occur. If we find a pricing error after you order, we will contact you before dispatch. You may confirm the order at the corrected price or cancel for a full refund. If an error is obvious and could reasonably have been recognised as an error, we are not obliged to supply at the incorrect price.

We may change prices at any time, but changes will not affect orders already accepted.

Promotional offers and discount codes may have separate stated terms, expiry dates and product exclusions. Unless stated otherwise, only one code may be used per order, codes cannot be combined or applied after an order is placed, and they have no cash value. Promotions are subject to availability and do not affect statutory rights.

7. How the Contract Is Formed and Age Requirement

You must be at least 18 years old to place an order. If you are under 18, a parent or guardian must place the order on your behalf.

Our display of products on the website is an invitation to make an offer, not an offer to sell. When you place an order, you make an offer to buy.

We will send an order acknowledgement confirming receipt. This does not mean the order has been accepted. A contract is formed only when we send a dispatch confirmation or, for Click & Collect, when we notify you that the order is ready. The contract relates only to products listed in that confirmation.

We may decline an order where, for example, a product is unavailable, payment is not authorised, information is incorrect, there is a pricing or description error, or we reasonably suspect fraud or misuse. If we decline an order, we will notify you and refund any payment taken.

8. Payment

Payment is taken when you place your order. We accept the payment methods shown at checkout.

Payments are processed by Stripe. Card details are entered directly into Stripe's payment interface, and we do not receive or store your full card number. Our handling of personal information is described in our Privacy Policy.

Delivery times are estimates. Delays may occur during busy periods or for reasons outside our control. Unless we agree a specific date in writing, consumer orders will be delivered within 30 days after the contract is formed.

For oversized, bulky, fragile or exceptionally heavy products, we will contact you before dispatch to explain the arrangements and any additional charge. You may cancel the affected item or order for a full refund if you do not accept the quotation.

Check that your delivery address and contact details are correct. We are not responsible for delays caused by incorrect or incomplete details. This does not affect responsibility for goods while they remain at our risk or any rights that cannot lawfully be excluded.

Orders not collected within 7 calendar days after the ready-for-collection notification may be cancelled and refunded. Contact us before the deadline if you need more time.

11. Risk and Ownership

For consumers, responsibility for products passes when the goods are physically delivered to you, or to a person you nominated who is not the carrier, or when you or your nominee collects them. Ownership passes when we receive payment in full.

For business customers, risk passes on delivery to the delivery address or collection by you or your nominated carrier, unless otherwise agreed in writing. Ownership passes when we receive payment in full.

12. Your Right to Cancel - Consumers

This section applies only to consumers. Business customers should read Section 14.

If you are a consumer buying online, you may cancel without giving a reason within 14 days after the day you, or a person nominated by you, receives the goods. If one order is delivered in several consignments, the period runs from receipt of the last consignment.

Use one cancellation method only: select the Withdraw From Contract button on our Returns & Exchanges page (no account or login is required), or email a clear cancellation statement to info@ersshop.ie. If you use the button, we will send an automated acknowledgement without delay. You may instead use the model form at the end of these terms, but it is optional. You do not need to use both the button and email.

After notifying us, return the goods without undue delay and no later than 14 days after the day you cancelled. The return address and instructions are in Section 15.

You are responsible for the direct return cost for a change-of-mind cancellation. For items that can be posted normally, this is the actual postal or courier charge. Bulky or heavy goods may require courier or pallet collection; where such goods cannot normally be returned by post, the applicable estimated return cost will be displayed or provided before purchase. If the legally required return-cost information was not provided before the contract was made, you will not be required to pay that cost.

We will refund the price paid and the cost of our least expensive standard delivery option. Any extra amount paid for a more expensive delivery service is not refundable. Refunds use the original payment method unless you expressly agree otherwise, and no refund fee is charged.

We will refund without undue delay and no later than 14 days after we are informed of your cancellation. We may withhold the refund until we receive the goods or you provide evidence that you sent them back, whichever occurs first.

You may inspect goods as you would in a shop. If handling goes beyond what is necessary to establish their nature, characteristics and functioning, we may reduce the refund to reflect the resulting loss in value.

The change-of-mind right does not apply to goods made to your specifications or clearly personalised; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed; sealed audio, video or computer software once unsealed; or goods inseparably mixed with other items after delivery. These exceptions do not affect rights where goods are faulty or incorrectly supplied.

13. Faulty, Damaged or Incorrect Goods

Inspect your order when it arrives. If an item is faulty, damaged in transit, not as described or supplied incorrectly, contact info@ersshop.ie with your order number and details of the issue. Prompt reporting helps us investigate, but delay does not by itself remove statutory rights.

For consumer purchases, goods that do not conform to the contract may carry a 30-day short-term right to end the contract for a full refund. You may instead choose repair or replacement where available. After 30 days, repair or replacement will normally be the first remedy; a price reduction or refund may be available where the fault is serious, a remedy is impossible, or repair or replacement is unsuccessful.

Where goods are faulty, damaged in transit or supplied in error, we will arrange collection or reimburse reasonable return costs. You do not need the original packaging to exercise statutory rights, although secure packaging may be necessary for safe return.

A manufacturer's guarantee is additional to legal rights, not a replacement for them. Damage caused by misuse, unauthorised modification, use contrary to instructions or normal wear of consumable parts is not treated as an inherent fault, although each case will be assessed on its facts.

14. Returns - Business Customers

The 14-day cancellation right in Section 12 is a consumer right and does not apply to business customers.

If a business customer wishes to return correctly supplied goods that are no longer required, the return requires prior written management approval. Goods must be unused, complete, resaleable and in their original undamaged packaging. Special-order, customised and non-stock items cannot normally be returned.

A restocking fee may apply. We will disclose the amount before approving the return, and no goods should be sent until written approval and return instructions have been issued. Approval is discretionary and may take account of the product, condition, time since delivery and supplier terms.

This does not affect contractual rights where business goods are faulty, damaged in transit or supplied in error. Section 13 applies to those situations as appropriate.

15. Returning Goods to Us

Submit a cancellation notice or contact us before returning goods so we can identify the order and provide the appropriate instructions. Include a copy of your order confirmation or invoice in the parcel.

Use secure packaging and retain proof of postage or tracking. Unless we arrange collection, returned goods remain your responsibility until they reach our warehouse. Valid evidence of return should show the destination and dispatch date.

16. Our Liability

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, liability under the Liability for Defective Products Act 1991, and any Consumer Rights Act 2022 liability that cannot be excluded.

If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. We are not liable for business losses suffered by a consumer.

If you are a business customer, we are not liable for loss of profit, business, contracts, anticipated savings or data, or for indirect or consequential loss, however arising. Subject to liabilities that cannot lawfully be limited, our total liability connected with an order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price paid for the products concerned.

17. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including severe weather, fire, flood, industrial action, transport or communications failure, and acts of government. We will contact you where practical and take reasonable steps to minimise delay. If a delay is substantial, you may cancel the affected order and receive a refund for products not supplied.

18. Website, Customer Accounts and Intellectual Property

If you create an account, provide accurate information, keep your login details confidential and notify us promptly if you suspect unauthorised access. We may temporarily suspend or close an account where reasonably necessary to protect security, investigate fraud or prevent misuse. This does not remove rights relating to accepted orders.

All content on www.ersshop.ie, including text, images, logos and product data, is owned by us or our licensors and protected by intellectual property law. You may view and print content for personal use, but may not reproduce, distribute or use it commercially without written permission.

We aim to keep the website available and accurate but do not guarantee uninterrupted access. We may maintain, suspend, withdraw or change parts of the website where reasonably necessary.

19. Your Personal Information

We handle personal information in accordance with our Privacy Policy and Cookie Policy, available on our website. These explain how information is used for orders, payments, delivery, accounts, marketing and website operation.

20. Complaints and Consumer Redress

If something has gone wrong, contact info@ersshop.ie or (061) 500 600 and include your order number where relevant. We will try to resolve the issue directly.

Consumers can obtain information and advice from the Competition and Consumer Protection Commission at www.ccpc.ie. The European Commission also publishes a current list of recognised consumer dispute-resolution bodies on its Consumer Redress website.

21. General

We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens and it will not affect consumer rights.

If any provision is unlawful or unenforceable, the remaining provisions continue in force.

If we do not immediately enforce an obligation or right, that does not mean we have waived it.

We may change these terms from time to time. The terms applying to an order are those published when the order was placed, unless a change is required by law and lawfully applies to that order.

22. Governing Law

These terms are governed by Irish law, and the Irish courts have jurisdiction over disputes.

If you are a consumer resident in another EU member state, you also retain any mandatory protection under the law of your country of residence and may bring proceedings there where applicable.
