We want you to shop with confidence. This policy explains how to cancel an online consumer purchase, return goods, request an exchange or receive a refund. It also explains the separate arrangements for trade and business customers.
1. Who This Policy Applies To
Consumer purchases. A consumer is an individual buying wholly or mainly for purposes outside their trade, business, craft or profession. Consumers who buy online normally have the statutory 14-day right to cancel described below.
Trade and business purchases. The automatic 14-day change-of-mind cancellation right does not apply to purchases made wholly or mainly for trade or business purposes. Any return of correctly supplied trade or business goods requires prior written approval from ERS Shop and is subject to Section 13 of our Terms and Conditions. A restocking fee may apply; if so, we will tell you the amount before approving the return. This does not limit any contractual rights that apply where business goods are faulty or incorrectly supplied.
2. Consumer Right to Withdraw
If you are a consumer and buy goods online, you may cancel the contract without giving a reason within 14 days of the day you, or a person nominated by you, receives the goods. After notifying us, you must send the goods back within a further 14 days.
Fastest option: select the Withdraw From Contract button at the top of the webpage, enter your order number and email address, and select the items concerned. No account or login is required. We will send an automated acknowledgement without delay.
Alternatively, email a clear statement that you wish to cancel to info@ersshop.ie before the 14-day period expires. Include your name, order number and the goods concerned so we can identify the order. The website button is convenient, but it is not the only way to exercise your statutory right.
3. Exceptions to the Change-of-Mind Right
The 14-day right to cancel does not apply in certain cases, including:
- goods made to your specifications or clearly personalised;
- goods liable to deteriorate or expire rapidly;
- sealed goods that are unsuitable for return for health-protection or hygiene reasons once unsealed;
- goods that become inseparably mixed with other items after delivery; and
- sealed audio, video or computer software once unsealed.
These exceptions do not affect your rights where goods are faulty, damaged, not as described or supplied incorrectly.
4. Conditions for Change-of-Mind Returns
To receive a full refund, please return the goods:
- clean and in a resaleable condition;
- complete with all accessories, manuals and components supplied;
- in the original packaging where reasonably possible; and
- not used beyond what is necessary to inspect their nature, characteristics and functionality.
You may inspect goods as you would in a shop. If your handling goes beyond what is necessary to establish their nature, characteristics and functionality, we may reduce the refund to reflect any resulting loss in value. Original packaging is requested where reasonably possible, but its absence does not by itself remove a consumer’s statutory rights.
5. How to Return Your Items
- Submit your notice. Use the Withdraw From Contract button or email info@ersshop.ie within the applicable cancellation period.
- Receive acknowledgement. If you use the website button, our system will send an automated acknowledgement. If you email us, we will reply with the appropriate return instructions.
- Pack the goods securely. Include a copy of your order confirmation or invoice so our team can identify the parcel.
- Send or bring the return. Post or arrange delivery to the following address, or bring the goods to our counter at the same address during opening hours, within 14 days after notifying us:
ERS Shop Returns
Unit B1 Corcanree Business Park
Dock Road
Limerick
V94 H5W4
We strongly recommend using a tracked service and keeping proof of postage. Returned goods remain your responsibility until they reach our warehouse. Valid proof of return should be an official postal or courier receipt or tracking reference showing the destination address and dispatch date. If you return goods in person, please bring your order confirmation or invoice, and we will give you a written receipt for the items returned.
6. Return Shipping Costs
- Change of mind: you are responsible for the direct cost of returning the goods.
- Faulty, damaged or incorrect goods: ERS Shop will bear the reasonable return cost. Please contact us before sending the goods so we can provide the appropriate instructions.
7. Refunds
For a valid consumer cancellation, we will refund the price paid and the cost of our least expensive standard delivery option. If you chose a more expensive delivery service, the additional delivery charge is not refundable.
We will make the refund without undue delay and no later than 14 days after the day we are informed of your decision to cancel. We may withhold the refund until we receive the goods or you provide evidence that you sent them back, whichever occurs first.
Refunds will be made using the original payment method unless you expressly agree otherwise, and no refund fee will be charged. Any permitted deduction for diminished value will be explained to you.
8. Exchanges & Store Credit
If you prefer, you may request an exchange or store credit instead of a refund. These options are subject to product availability and the applicable return conditions. We will not substitute store credit for a statutory refund unless you choose it.
9. Faulty, Damaged or Incorrect Items
If an item is faulty, damaged in transit, not as described or supplied incorrectly, email info@ersshop.ie with your order number and details of the issue. Reporting promptly helps us resolve the matter, but a delay does not by itself remove your statutory rights.
For consumer purchases, goods that do not conform to the contract may carry a 30-day short-term right to end the contract for a full refund. You may instead choose repair or replacement where available. After 30 days, repair or replacement will normally be the first remedy; a price reduction or refund may be available if the fault is serious, a remedy is impossible, or repair or replacement is unsuccessful. ERS Shop will cover the reasonable cost of returning faulty, damaged or incorrectly supplied goods.
10. Contact & Statutory Rights
For return queries, contact info@ersshop.ie.Send or bring returns only after submitting your notice or contacting us, using the address in Section 5. Nothing in this policy excludes or limits any rights or remedies available to consumers under applicable Irish law.
